The Gateshead Definitive Map and Statement of Public Rights of Way pdf icon PDF 63 KB

Minutes:

The Committee were updated on the work which has been undertaken to update and consolidate the definitive maps of public rights of way and statements for Gateshead.

 

In accordance with approval by the Rights of Way Committee on 23 October 2009 a map and statement for the former excluded area of central Gateshead has been incorporated into the Definitive map and statement for Gateshead Rights of Way.

 

A Legal Event Modification Order, with a relevant date for the order being 8 March 2018 was made on 13 June 2018 incorporating all the completed legal events to that date.

 

The Legal Event Modification Order was made under section 53(2)(a) and section 53(2)(b) of the Wildlife and Countryside Act 1981has recorded all the legal events that have occurred since the previous definitive map was produced in 1965 and 1967 up to date.

 

The production of a map and statement for the former excluded area and the making of a Legal Event Modification Order to record all outstanding events on the definitive map and statement have now been completed, the Council were able to produce in accordance with section 57A of the Wildlife and Countryside Act 1981, a new consolidated definitive map and statement on 31 May 2018.  This will now replace the previous definitive rights of way in Gateshead.  Notice of the consolidation of the new definitive maps and statement were advertised in the press and on the Council’s website on the Friday 6 July 2018.

 

Any changes to the definitive map due to orders made after 31 May 2018 can be viewed on the online working copy of the definitive map on Gateshead Council’s website.  When further changes are made to the definitive map and statements for Gateshead, then the definitive map and statement will need to be reviewed and updated by way of a further Legal Event Modification Order.

 

RESOLVED -  That the contents of the report be noted.

The Committee were updated with regards to Legal Matters and to Principal Works carried out between November 2017 and July 2018.

·         Bowes, Birtley Bridleway

·         Keelmans Way, Ryton

·         Clematis Crescent, Eighton Banks

·         Derwent Cycle Route, Swalwell

·         Hurrocks Allotments, Swalwell

·         Bowes at Rear of Whitemere School, Felling

·         Woodhouse Lane, Fellside Whickham, Northern and Southern Sections.
