RESOLVED -

That the membership of the sub-committee be noted as Councillors Malcolm Brain, Gary Haley and Liz Twist.

Terms of Reference

That the delegated powers to determine licensing applications under the Scrap Metal Dealers Act 2013 where it is proposed to refuse an application or to revoke or vary a licence and the applicant or licensee has a right to make representations under the provisions of paragraph 7 of Schedule 1of the Act be noted.

Exclusion of the Press and Public

Minutes:

 

RESOLVED -

that the press and public be excluded from the meeting during consideration of the remaining business in accordance with the indicated paragraphs of Schedule 12A of the Local Government Act 1972.

 

 

4.

Application to Grant a Scrap Metal Dealer Collectors Licence - RC/04/17

Minutes:

RESOLVED -

The Executive Sub-Committee determined that they were not satisfied that the applicant (RC/04/17) was a suitable person to be issued with a scrap metal site licence by Gateshead Council at this time.

 

The Applicant was advised that he has a right of appeal against this decision.

 

The appeal is to be brought to the Gateshead Magistrates’ Court within 21 days beginning the day on which the Applicant received this Notice of Decision.

 

The decision has immediate effect. The Applicant may not collect scrap metal in the Borough of Gateshead unless and until a direction is made by Gateshead Magistrates’ Court pursuant to paragraph 9(6) of Schedule 1 of the Act, or the Applicant makes a further application to Gateshead Council which is then granted.

 

Any person intending to appeal this decision should seek legal advice as quickly as possible as there are strict time limits to adhere to.

RESOLVED -

That the Executive Sub-Committee determined that they were satisfied that the Applicant is suitable person to be issued with a scrap metal collector licence by Gateshead Council at this time.
